Their studies have enhanced our understanding of incentives by examining how contracts affect relationships between employers, employees, societies and governments. The application of incentives to IP is broad - the innovation/social contract approach to IP, patents as performance indicators in employment contracts, and, the bread-and-butter of IP, licensing contracts.

Eyes on the Prize
First of all, a bit of background. If you are an economist who supports the selection, i.e. that the winning economists work supports your own work, then you must praise the Nobel committees choice and the prestige of the prize. If you are not, then you must highlight that the economics prize is not a true Nobel prize, as it is comes from the Swedish National Bank, and therefore is not particularly impressive. Either way, one must be careful not to be too enthusiastic about a fellow economists success, lest it be taken for indication of an emotional imbalance.

Hart and Holmström have won the prize because ~~their names both start with H~~ they developed complementary contract theories. Holmström began by studying trade-offs in contracts. Harts recent work on prisons illustrates this; summarised by The Economist: "In publicly owned prisons, managers might underinvest in quality-improving measures, but private owners face too strong an incentive to cut costs, leading to conditions for prisoners that are worse than those in public prisons." These incentives apply to most government services. A privatised patent-granting body would have different incentives than a public body (think of those renewal fee$!)

Contracts and IP
Readers of Katonomics will be familiar with economists focus on the incentives-to-innovate theory of IP. This is often known as the Social Contract (covered previously here), in which IP is a contract between innovators and society; the monopoly protection of IP provides a long-term incentive to innovate. Society cannot foresee (information asymmetry) the value of each potential innovation, so all innovators are granted the same level of protection. Assigning the property right to the innovator incentivises innovation as the innovator has a stake in the outcome and the IP system as a whole.

A goal of researcher employment contracts is to align firms innovation needs with employee incentives. Patents are sometimes used as a metric of performance. There is a large body of economic analysis on the use of patents as a measure of innovation; the general conclusion of which is that patents measure patents, not innovation. More specifically, Harhoff and Hoisl (2007) examine German policies via a large survey, and find that, unsurprisingly, more valuable patents are associated with higher levels of employee compensation. Baker (1992) models scientists salaries as entirely dependent on the number of patents they produce (a problematic assumption.) In his model, scientists are unduly incentivised to work on "easy" patents and therefore the employer reduces the per-patent payment to avoid overpaying. Japan has recently changed its approach to patents, making it easier for employers to own patents generated by employees.

Finally, licensing contracts enjoy a never-ending analysis of incentives and clauses. The primary job of lawyers negotiating and drafting such contracts is to align the incentives in the contract with the needs of the client. While researching the biotech sector in 2007, I came across an interesting case. My interviewee had exclusively licensed a product on a royalty basis. The licensee instead marketed a competing product, leaving the licensor without royalties. The contract had been used to eliminate competition from the market, and failed to align the parties incentives. Another anecdote is the use by wealthy Multi-national Companies (MNC) of reversion clauses when partnering with companies in developing countries. The MNC engages in joint research and market expansion, then deliberately causes the project to fail in order to trigger the reversion clause. Both background and foreground IP, as per the contract, revert to the MNC. Its a cheap way to expand internationally.

A little less than half the sky

The roads were deserted, the sky was dark and the only thing that engulfed the whole atmosphere was silence. I am not talking about suburbs but about the capital city, New Delhi after midnight.A few days ago I had to go for a friends marriage from Pitampura to Dwarka. Living alone in Delhi for the past 6 years or so I have never been able to (read dared to) venture out alone after 9p.m..

Which means I have missed a lot of weddings, dinners, parties and umpteen other important occasions and made a lot of excuses to cover up the same. So while sometimes my roommate fell ill at other times I had to slip from the stairs.

But after my stay in Odisha for a year, I feel a little liberated. But this liberation and freedom is also a little scary sometimes. This time when I received the invitation, I decided that neither my roomie is going to fall ill nor am I going to break my leg, I am simply going to enjoy my friends wedding. Well what about the things like Carpe Diem and Equality and Friendship and love.

So there I was. I attended the wedding and it was an achievement. And why not? For a Delhi girl in the 21^st Century it is an achievement to be out that late. But as the clock struck 10, I started to freak out because I realised that however modern I can pose to be my opposite sex has somehow failed to control their libido. The next one hour was spent in finding cabs and hearing lectures about my foolishness from a friend (all out of care though). Yes I am not the plan everything in advance types, but I am also not flow with the current types.

I wondered if I was really wrong in choosing to come out for this adventure (which for most might not be an adventure at all). And then the recent case of a girl getting raped by a Uber cab driver have given me all the answers. Unfortunately, I dont like these answers but I have to accept them.

I boarded the last metro on the Airport Express Line from Dwarka Sec 21 to New Delhi with a male friend of mine. The friend who was doubting my sanity agreed to pick me up from New Delhi Railway Station and then I saw the Delhi I had never seen. Delhi at midnight is beautiful to say the least (at least from inside the car windows and with guy friends you can trust). Even the dingy hotels of Karol Bagh and Paharganj seem like perfectly placed.

When I looked out of the metro glass I wondered in the past six years had I not missed enjoying one of the most beautiful sights. I mean look at the sky and the surroundings at Dwarka Sector 21 metro station at 11:00 p.m. and you will understand what I mean. My friend who accompanied me in the metro could not stop praising the sanctity of the place on a full moon night.

So as I my friend picked me up from New Delhi with his brother, I hopped inside the car like a child who travels by a train for the first time and gets glued to the window excited about the fact that the trees, the mountains and the houses are moving backward.

I took the backseat and gazed at the same trees, same roads and same houses and shops which I have seen not less than a thousand times in awe and admiration. Look at the Indian Tricolour fluttering at Cannaught Place at midnight, the saffron, the white and the green mixing in each other as well the dark and you cant escape jitters of patriotism. But at the very same instant, I regretted for the not being free enough to witness my own tricolour whenever I want to.

As our car raced towards Pitampura, I wished for the night to never get over. But at the same time, I wished if my city could be a little more safer and could accept me in entirety. I have not traveled much but I just wonder if it is a case in other parts of the world as well. If all over the world females are dependent on a male friend or relative to help her take simple decisions like going out for a friends wedding. Have we made our homes so unsafe that we doubt everyone.

Delhi is more than my hometown to me. She has taught me how to be independent, she has taught me to celebrate small victories and she has taught me to forget big failures. She has made me witness life closely, she has given me the courage to live out of my comfort zone, she has in a way brought me closer to myself. I refer to Delhi as she because she is both beautiful and desirable but it really hurts to realise that the way I have accepted her, she has not accepted me. She has given me everything from acceptance to friends to love, except the freedom to enjoy my freedom. To cover my head, she has given me (read the female gender) only a little less than what I (read all of us) deserved – half the sky, a little less than half the sky.

General Court confirms that body builder silhouette cannot be registered as a trade mark for nutritional supplements

The body-builder silhouette

Can “a silhouette, represented in black, of a person adopting a typical body-building pose displaying the muscles of his body” be registered as a trade mark for – among other things – nutritional supplements, clothing, and footwear?

As Katfriend Nedim Malovic (@malovicSE) explains, this very question has been recently addressed by the General Court.

Here’s what Nedim writes:

“In its judgmenton 29 September 2016 (Universal Protein Supplements Corp v European Union Intellectual Property Office Case, T-335/15, EU:T:2016:579) the General Court upheld the decision of the Fifth Board of Appeal of the European Union Intellectual Property Office (EUIPO) concerning an application to register a figurative sign representing a body-builder as a EU trade mark for the following classes of goods and services, and descriptions:

Class 5: ‘Nutritional supplements’;
Class 25: ‘Clothing; footwear’;
Class 35: ‘On-line retail store services featuring nutritional supplements; health and diet-related products; clothing and footwear’.

Background

In 2014 the applicant, Universal Protein Supplements Corp, filed an application with the EUIPO to have the EU territory designed in respect of the international registration of a figurative sign representing a body-builder. The application was for goods and services in the classes indicated above.

The EUIPO examiner rejected the application, on grounds that the mark lacked any distinctive character and was descriptive for the purpose of Article 7(1)(c) of Regulation No 207/2009 on the (now) European Union Trade Mark (EUTMR).

In late 2014 Universal Protein appealed the examiner’s decision.

The EUIPO Fifth Board of Appeal dismissed the appeal in March 2015. It held that the message conveyed by the sign related to ‘body-building’ or a ‘body-builder’ and that the relevant public would perceive a direct and specific link between the sign and the goods and services designated by the mark applied for.

The Board of Appeal concluded that such mark fell within the prohibition laid down in Article 7(1)(c) EUTMR. Furthermore, the mark was devoid of any distinctive character within the meaning of Article 7(1) (b) EUTMR, on the ground that it merely consisted of a representation of a body-builder, which would not enable the relevant public to perceive it as an indication of the commercial origin of the goods and services in question.

Universal Protein did not however lose hope, and decided to appeal the decision before the General Court. It claimed that: (i) the Fifth Board of Appeal had failed to consider the mark as a whole; (ii) that its own image of the body-builder has several meanings and conveys a message that goes beyond that of a ‘body-builder’ or ‘body-building’, and (iii) that securing registration would not impair the public interest aim that descriptive signs are not monopolised by economic operators.

Analysis

The General court began by examining whether Universal Protein’s mark should be considered descriptive.

Article 7(1)(c) EUTMR pursues a public interest aim. Referring to Agencja Wydawnicza Technopol, the court recalled that a sign that is descriptive of the characteristics of the relevant goods or services ought to be freely available for use. In addition, a sign of this kind fails to fulfil the essential function of a trade mark, ie to identify the commercial origin of one’s own goods or services.

The General Court then stated that the descriptive nature of a sign is only to be assessed, (1) by reference to the way in which it is perceived by the relevant public, and (2) by reference to the goods or services concerned:

(1) Having regard to the relevant goods and services (nutritional supplements, clothing, footwear and online retail services relating to those goods) and considering that the mark is strictly figurative and lacks any verbal element, the average consumer – obviously reasonably well informed and reasonably observant and circumspect – is the public of the entire European Union. This said, because the sign consists of a typical body-builder, displaying the muscles of his body, represented in black silhouette, the message conveyed by that sign would relate to body-building.

(2) The chosen goods and services in Classes 5 (nutritional supplements), 25 (clothing; footwear), and 35 (online retail store services featuring nutritional supplements; health and diet-related products; clothing and shoes), are all indicative that the mark applied for has a sufficiently direct and specific link with nutritional supplements, clothing, footwear, and online retail store services of those goods and goods related to health and diet. According to the court, even if the categories of goods and services at issue were to also include services with no link to body-building and that, accordingly, the sign at issue were not descriptive of all the goods and services in those categories, the applicant had applied for the registration of the sign at issue for each of these as a whole without making any distinction. Accordingly, the body-builder sign would fall within the prohibition set by Article 7(1)(c) EUTMR.

Contrary to the applicant’s claims, the court found that the alleged aesthetic character of the stylised image does not require any mental effort on behalf of the relevant public. The meaning of the sign at issue (which refers to the concept of ‘body-builder’ or ‘body-building’) is immediately clear. By referring to earlier case law, the court added that, even assuming that a sign has several meanings, if at least one of the meanings designates a characteristic of the goods concerned, then that sign must be equally refused.

The applicant’s further claim that there would be no general interest in requiring that a representation such as that in the present case be available because there are practically unlimited ways of depicting body-builders was regarded as irrelevant. In that respect, the court noted (as also previously stated by the EUIPO) that, according to settled case-law, the application of Article 7(1)(c) of the EUTMR does not depend on the existence of a real, current or serious need to leave a sign free.

The Board of Appeal was therefore correct in concluding that the sign in question is descriptive for the purpose of Article 7(1)(c) EUTMR.

All this said, the court considered unnecessary to review whether the sign at issue would be distinctive, and concluded that the body-builder silhouette could not be registered as a trade mark because of the prohibition in Article 7(1)(c) EUTMR.

Conclusion

This decision appears correct from a formal standpoint, and probably the General Court was concerned with the implications of creating a monopoly over the use of a silhouette of this kind for such types of goods and services. However, in the past there have been decisions that could have supported a different outcome. For instance, it is unclear why the silhouette of a body-builder should be descriptive of nutritional supplements, while a hand with a smile and crossed fingers should not suggest “best of luck” and describe what the concept of lottery is all about. Yet, the National Lottery ‘hand’ was successfully registered as a EU trade mark.”

Google Fiber, Facebook, AT&T and Verizon are a few of the leading firms now developing or planning to use fixed wireless in a significant way for Internet access.

Cambridge Broadband Networks (CBNL) is providing the radios and and Straight Path Communications is supplying the spectrum licenses for the Windstream rollout.

The new technology will allow Windstream customers data speeds of up to 275 Mbps full duplex, and it also supplements Windstreams other fixed wireless access technologies that range in speed from 1 Mbps to 1 Gbps.

Windstream will deploy in seven existing markets where it currently offers fixed wireless access technology - Chicago, New York City, Boston, Cleveland, Philadelphia, Milwaukee and Little Rock using equipment from CBNL and spectrum from Straight Path.

Windstream will also deploy CNBL equipment in 33 new markets where it will begin offering its fixed wireless technology. Those markets include Atlanta, Baltimore, Charlotte, Cincinnati, Dallas, Detroit, Kansas City, Miami, Minneapolis,Nashville, Oklahoma City, Phoenix, Richmond, San Antonio, Seattle and St. Louis.

Under the agreement, Windstream has the option of eventually expanding fixed wireless to an additional 32 markets where Straight Path owns 39 GHz spectrum.

Reliance Jio Gets 16 Million Mobile Accounts in a Month

Reliance Jio Infocomm has signed up 16 million customers (net new accounts) in its first month of full commercial operations since September 2016.

Reliance Jio has been offering free services for free to anyone signing up before the end of the year, including four gigabytes (4 GB) of free 4G data each day, as well as unlimited voice calls until December 31, 2016.

Customers will begin paying for data charges in 2017 but domestic voice calls will continue to be free.

HTC Trying To Work On A Windows Phone Version Of The One M9 !!

According to new reports, HTC might have a Windows Phone variant of the One M9 scheduled for launch sometime later this year. It mentions that HTC will not launch the Android and Windows Phone models of the One M9 together.

Is there a competition law issue lurking on the horizon of cloud computing

Are we on the cusp of a potential competition law problem in the area of cloud computing services? The Economist tantalizingly, in an article entitled “Cloud Chronicles”, which appeared in its August 27th issue, has described the present circumstances of the industry, and why there might be room for future competition law concern. In 2006, Amazon made available a beta version of a service called “Elastic Compute Cloud”, described as

“the central offering” of AWS. The service took off, in part, according to the article, because it coincided with the rise of the smartphone and the supporting app industry. Developers loved the opportunity to forego maintaining a hardware system and paying a fixed fee for use of software, in favor of paying only for the capacity that they used. AWS is said to have engaged in “many rounds of price reductions”, enabling it to capture increased market share. As well, AWS has, and continues to offer, an increasing number of add-on services, the marginal cost for which is minimal since the software has already been developed.

As such, AWS early on enjoyed first mover advantage (being the first cloud computing service “to succeed on a large scale”) and continues to benefit from network effects. As well, the burden of switching costs served to make it more likely that a user will be reluctant to move to another cloud service. Based on these advantages, AWS has raced far ahead of its competition. It is three times larger than its nearest competitor—Microsoft Azure. Other potential competitors are even less visible, including competing offerings from IBM and Google. At least these two hi-tech behemoths are still in the game; Hewlett-Packard has apparently simply withdrawn from the field. Even Salesforce.com, which is a prominent provider of on-line applications, announced that it will begin to make use of AWS services.

What will slow AWS’s continued dominant position in the industry? The article suggests that users are aggressive in trying to avoid being locked-in to AWS as their sole cloud services provider. It further reports that, at least in Europe, two-fifths of the companies in the cloud use more than one cloud service. Also, while the AWS service is highly popular with start-up developers, it has less success in attracting larger, established companies, in part, it would seem, from a hesitation by such companies to be tied up with a potential competitor, given the ever-increasing nature of Amazon’s product and service offerings. These countervailing forces argue that there may be a limit as to how much more AWS can grow.

Still, based on the information in the article, AWS does seem to enjoy a dominant position with smaller developers. If this were to be found to be the relevant population for vetting competition law concerns, then attention to pricing (should prices begin to tick upwards) and the ease or difficulty of switching to another cloud service, bears watch, especially since the computing infrastructure required might serve as a potential barrier to entry for competitors. Or perhaps less conventional metrics will be brought to bear. The article itself does not go into a discussion of how anti-competitive behavior by AWS might look, stating merely that—

“AWS could end up dominating the IT industry just as IBM’s System/360, a family of mainframe computers, did until the 1980s. If that happens, the antitrust authorities may eventually have to step in, as they did with IBM.”

This in itself is an interesting comment. This Kat is hoary enough to remember the antitrust case against IBM, filed in 1969, which dragged on until 1982. There, the issue was IBM’s alleged anti-competitive conduct based on its alleged dominance of the mainframe computer industry. What is notable is that this decade-long lawsuit came to an end because the US Depart of Justice ultimately decided to dismiss the case. Developments in the computer world had moved on since the filing of the law suit in the late 1960’s, and the capacity of IBM to dominate the computer world had passed.

Even more, this Kat remembers the frequently made comment that antitrust suits such as the IBM case, especially in the technology area, are almost always late to the game: either the technology is passing the target industry by, or the law suit is a cue to the target to seek new products and markets. If this be true, then it raises an interesting question: what would the filing of such a law suit say about the cloud-computing industry? Is the pace of innovation so seriously stuck in neutral, and the nature of cloud-computing so very different from the world of IBM’s System/ 360 family of mainframe computers, that there might be greater justification in considering such a law suit, should there be prima facie indicia of anti-competitive behavior?
